Audible Studios Audiobook Narration Casting Call

Presented by Audible Studios ("Sponsor")

Sponsor and its affiliates propose but do not undertake to produce and commercially release two audiobooks based on the following material: "Raiders!: The Story of the Greatest Fan Film Ever Made" by Alan Eisenstock and "Counterclockwise: My Year of Hypnosis, Hormones, Dark Chocolate, and Other Adventures in the World of Anti-Aging" by Lauren Kessler (the "Audiobooks" and each an "Audiobook").

Please read these rules ("Official Rules") before entering the Audible Studios Audiobook Narration Casting Call which Sponsor is running in connection with the casting for the Audiobooks ("Casting"). By submitting an entry, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Sponsor and the judges, and that you satisfy all eligibility requirements.

  1. ELIGIBILITY. Open to legal residents of: (i) the 50 United States and the District of Columbia who are the older of 18 years old or the age of majority in the state in which they reside at the time of entry; or (ii) the United Kingdom who are aged 18 or older at the time of entry.  The Casting is not open to employees or independent contractors, or immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) and/or those living in the same household of employees or independent contractors of Sponsor, any entity involved in any aspect of the Casting (including funding or judging), advertising agencies, and each of their respective parents, subsidiaries, affiliates, advisors, or advertising/promotion agencies.

  2. HOW TO ENTER. Casting entry period begins May 1, 2014 at 12:01 a.m. (EDT)/05:01 a.m. (BST) and ends May 16, 2014 at 11:59 a.m. (EDT)/4:59 p.m. (BST) ("Entry Period"). To enter your audition comprising your voice recording of Sponsor's pre-selected material("Audition"), during the Entry Period, visit or, and follow the instructions on how to create and upload your Audition. Entrants must have an account and profile on Sponsor's ACX service ("ACX"), which can be created at the time of uploading your Audition. Male entrants must audition for "Raiders!: The Story of the Greatest Fan Film Ever Made" by Alan Eisenstock. Female entrants must audition for "Counterclockwise: My Year of Hypnosis, Hormones, Dark Chocolate, and Other Adventures in the World of Anti-Aging" by Lauren Kessler. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible Entries. The Audition and associated information are collectively referred to as the "Entry" or "Entries." All Entries must be received by 11:59 a.m. (EDT)/4:59 p.m. (BST) on May 16, 2014. Auditions must comply with the technical specifications of ACX as Sponsor may make available from time to time. Each Audition must contain only the recorded voice of the entrant and be in the English language. All Entries determined by Sponsor in its sole discretion to meet the foregoing requirements will be "Valid Entries." Sponsor's servers and clock will be the official clock for all phases of the Casting, and entrant's proof of a submission does not constitute proof of receipt by Sponsor. Sponsor is not responsible for (i) lost, misdirected, late, incomplete, illegible, or unintelligible Entries or for inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in the Casting, or by any technical or human error that may occur in the processing of Entries; or (ii) any printing, production, human or typographical errors in any materials associated with the Casting. Limit one Entry per ACX account and person. In the event any entrant submits more than one Entry, the first Entry received by Sponsor will be that entrant's Entry, and the subsequent submissions will be disregarded. Sponsor reserves the right in its sole and unfettered discretion to disqualify at any time any Entry containing obscene, offensive, pornographic or sexually explicit material, or libelous, disparaging or other inappropriate content or subject matter (as determined by Sponsor in its sole discretion). Entrants are responsible for mobile and cell data and/or other Internet connection charges for entry.

  3. CONDITIONS OF ENTRY. All Entries must contain solely the voice of the entrants, and by submitting an Entry, each entrant grants to Sponsor, in addition to any rights granted to Sponsor pursuant to the ACX Account Holder's Agreement which is entered into when signing up to ACX, the non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right and license to use, reproduce, modify, edit, adapt, reformat, publish, translate, create derivative works from, distribute, perform, communicate to the public, display and otherwise exploit all or part of the Audition and Entry throughout the world in any media whether now known or hereafter developed. By submitting an Entry, each entrant represents and warrants that (i) his/her Audition contains solely the voice of the entrant; (ii) his/her Audition is the sole and exclusive property of the entrant; (iii) he/she has complete, worldwide distribution rights for his/her Audition; (iv) his/her Audition shall not infringe upon the intellectual property rights or other rights of any person or entity and shall not violate any applicable law; and (v) he/she will not distribute or exploit his/her Audition through any media channel prior to the conclusion of the Casting on May 19, 2014. Sponsor may disqualify any entrant whose Entry Sponsor determines, in its sole discretion, at any time not to comply with any requirement described in these Official Rules or the foregoing representations and warranties. Entrants agree to indemnify and hold harmless Sponsor and its affiliates, and any agents, employees or representatives of any of them (collectively, any "Sponsor-Related Person"), for: (i) any action or claim brought by a person whose consent entrant did not obtain; and (ii) any and all losses, damages and expenses (including legal fees) incurred or suffered by any Sponsor-Related Person in connection with an entrant's breach or non-compliance with any warranty, representation or undertaking contained in these Official Rules. Sponsor is collecting (and you hereby agree to the collection of) personal information primarily to process the Entries and to contact you if necessary, but also to potentially contact you for marketing purposes, provided that, in respect of UK entrants, you have ticked the relevant box on the application form. If you do not (or no longer) wish to be contacted for marketing purposes, you will be provided with a method to opt-out from future communications. If you would like to access the information about you related to this Casting in Sponsor's database, please send an e-mail to Sponsor will share your information with third parties that have a need to know, such as the judging panels, and by entering, you agree to the sharing of your information with the judging panels and third parties Sponsor retains to assist in administering the Casting. UK entrants acknowledge and accept that, for the purposes of administrating the Casting, the information you submit with your Audition and Entry (which may include personal information about you) may be transferred to, and used and accessed in, the United States of America. If required by Sponsor in its sole discretion, Winners agree to submit to a background check. If you do not agree to these terms or to Sponsor's privacy policy located at, please do not submit an Entry.

    Submission Period (May 1, 2014 - May 16, 2014).
    The Submission Period begins May 1, 2014 at 12:01 a.m. (EDT)/05:01 a.m. (BST) and ends May 16, 2014 at 11:59 a.m. (EDT)/4:59 p.m. (BST).
    Judging Period (May 19, 2014 - May 23, 2014).

    From May 19, 2014 through May 23, 2014, a panel of qualified judges (which panel will include at least one independent person) selected by Sponsor will review each Valid Entry. The names of the judges for Casting are available on request. Each Audition submitted as a Valid Entry will be judged and rated based on the following criteria: use of appropriate accents for the story, strong character delineation, strong storytelling style, presence in the scene, recording quality, and a conversational pacing (the "Judging Criteria"). The judges will select 2 winners from Valid Entries, one male and one female, based on the Judging Criteria (the "Winners" and each a "Winner"). In the event of a tie, the tie will be broken by the tied entries being judged and rated based on overall appeal. The Winners will be notified on or about May 28, 2014 by phone. The Winners will have 48 (forty eight) hours from the date and time the notification was sent to claim the prize by replying in the way required in the notification. If a Winner (or later substitute winner) of the prize does not respond within this timeframe, Sponsor reserves the right to disqualify the winner and select a substitute winner at its sole discretion.

  5. PRIZES. The two grand prize Winners will each receive the opportunity to be engaged by Sponsor (or its affiliates) to narrate one of the Audiobooks: "Raiders!: The Story of the Greatest Fan Film Ever Made" by Alan Eisenstock (for the male Winner) or "Counterclockwise: My Year of Hypnosis, Hormones, Dark Chocolate, and Other Adventures in the World of Anti-Aging" by Lauren Kessler (for the female Winner). The prizes have an approximate total value of US$2,915/approximately £1,737 (with approximately US$1,595 (approximately £951) for the male Winner and approximately US$1,320 (approximately £787) for the female Winner). Such prize value figures are approximate only and are based on anticipated fees which will fall due, on a finished recording hour basis, for completion and acceptance of full-length recordings of the Audiobooks (as may be determined by Sponsor in its discretion) subject to Sponsor's standard Voice-Over Performer Agreement. Each Winner is responsible for paying all costs and expenses related to the prize that are not specifically mentioned, including, but not limited to, taxes, and any other expenses that might reasonably be incurred by the Winner in using the prize. Without limiting the foregoing, the Winners will be solely responsible for all recording equipment and fees and expenses incurred by Winners (if any) in connection with the production of their Audition and full-length recordings for the Audiobooks. All prizes will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

    Affidavit and Release.
    To the extent that a Winner is a US entrant, such Winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Affidavit and Release") by June 4, 2014. Failure to return any required document by the date specified by Audible will deem the Winner as ineligible to receive a prize.

    Prior to awarding a prize, Sponsor may, in its sole discretion, require any potential Winner (whether such Winner is a US or UK entrant) to sign such additional documents Sponsor decides are necessary to confirm eligibility, to obtain a liability/publicity release, and to award any prize.

    Voiceover Contract.
    Furthermore, each Winner will be required to sign and return Sponsor's standard Voice-Over Performer Agreement to Sponsor by June 4, 2014. Each Winner hereby acknowledges and understands that under such Voice-Over Performer Agreement, among other things, he/she will be assigning exclusively, irrevocably, and in perpetuity, and on a royalty-free basis to Sponsor (or to Sponsor's affiliates) all copyright ownership and all other proprietary rights (including all performers' rights and rental and lending rights) in and to each of their Auditions and full-length recordings, such that Sponsor (and its affiliates) will have the unrestricted right to edit the Auditions and full-length recordings in any manner and to use (or not use) the Auditions and full-length recordings for any and all purposes whatsoever (including, without limitation, the creation of derivative works, and/or any and all other forms of commercial or non-commercial exploitation), regardless of whether or not related to the Casting or Audiobooks. Notwithstanding the foregoing or the generality of the Voice-Over Performer Agreement, entrants acknowledge and accept that under the Voice-Over Performer Agreement, each Winner will be required to produce and deliver the high-quality completed full-length recordings for the applicable Audiobook within 8 weeks following the date on which Sponsor receives such Winner's signed Voice-Over Performer Agreement. Subject to Sponsor's confirmation, it is currently anticipated that the total required length for "Raiders!: The Story of the Greatest Fan Film Ever Made" by Alan Eisenstock, is 9.96 hours, and the total required length for "Counterclockwise: My Year of Hypnosis, Hormones, Dark Chocolate, and Other Adventures in the World of Anti-Aging" by Lauren Kessler, is 8.25 hours.

    If any documentation is not returned by the specified dates or if any potential Winner declines to enter into such documentation or is deemed ineligible prior to the prize being awarded, Sponsor may, in its sole discretion, award the prize to the next entrant receiving the highest score.

    The prize, if won, could result in time off work or study. You should ensure prior to entering the Casting that you are able to take this time off work or study, where necessary. It is the sole responsibility of the Winners to arrange time off if necessary.

  7. ADDITIONAL TERMS. To the maximum extent permitted by applicable law, Sponsor reserves the right, in its sole discretion, to change these rules or cancel the Casting at any time, or to disqualify any entrant, or to modify, terminate, or suspend the Casting should viruses, worms, bugs, unauthorized human intervention, or other causes beyond Sponsor's control corrupt or impair the administration, security, fairness, or proper play of the Casting or submission of Entries. Furthermore and to the maximum extent permitted by applicable law, Sponsor reserves the right to disqualify and/or exclude, in its sole discretion, any entrant from the Casting for any reason or for no reason at all, including without limitation, for violation of these Official Terms. Sponsor is not responsible for any human or other error that may occur in the processing of the Entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to, or alteration of, Entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website. Sponsor is not responsible for injury or damage to any entrant's or any other computer resulting from downloading any materials in connection with the Casting. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process, the outcome of the Casting, or the operation of the Casting or website; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CASTING MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AFFILIATES RESERVE THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

  8. MISCELLANEOUS. The Casting, Audiobooks and all accompanying materials are copyright © 2014 by Audible, Inc. All rights reserved. By entering, entrants agree to be bound by these Official Rules. No transfer, assignment, cash redemption or substitution of prizes is permitted except by Sponsor due to prize availability and then with prizes of equal or greater value. Entrants agree (for themselves and their heirs) that Sponsor, and its affiliates, and all Sponsor-Related Persons, will have no liability, and will be held harmless by such entrants to the maximum extent permitted by law for any liability, loss, injury, or damage to property or to person, including death, and reasonable attorney's fees and court costs, due in whole or in part, directly or indirectly, by reason of participation in the Casting, or by reason of the acceptance, possession, use or misuse of the prizes, even if caused or contributed to by the negligence of Sponsor, any of its affiliates, or any such Sponsor-Related Person, save that, in respect of Entries received from UK entrants, nothing in these Official Rules shall be construed to limit or exclude any liability of Sponsor, any of its affiliates, or any such Sponsor-Related Person for fraudulent misrepresentation, fraud, death or personal injury caused by that party's negligence or any other liability to the extent the same may not be excluded or limited as a matter of law. These Official Rules are governed by the laws of the United States and the State of New York. As a condition of participating in this Casting, entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Casting, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York County, New York having jurisdiction. Further, in any such dispute, under no circumstances will entrants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental or consequential damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (e.g. costs associated with entering), and entrant further waives all rights to have damages multiplied or increased. Casting is void where prohibited by law. No term of these Official Rules shall be enforceable by any person who is not a party to them. Entrants agree that the decisions of Sponsor and the judges related to the Casting are final. By participating in the Casting, entrants consent to the use of their names, biographical information, and photographs, recordings, videos and/or likenesses in any manner and in any medium for any purpose in connection with the Casting, the Audiobooks or post-Casting publicity, including worldwide, without additional compensation, except where prohibited by law. Each entrant acknowledges and accepts that, with respect to any claim by such entrant relating to or arising out of the actual or alleged exploitation of the Audition, the Audiobooks or other materials submitted in connection with the Casting, the damage (if any) caused to the entrant will not be irreparable or otherwise sufficient to entitle the entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution or exploitation of the Audition, Audiobooks or other materials submitted in connection with the Casting, and the entrant's rights and remedies in any such event shall be limited to the right to recover damages (if any) in an action at law.
